Agreements

Three short agreements. Each one opens here, so you can read it without leaving.

Read the Privacy PolicyWhat we hold, why, and who can see it.

Revision note: Section 8 now states plainly that written work a learner submits in a learning tool may be read by an artificial-intelligence provider to give feedback, on what terms, and that the same reading may raise a possible safety concern to trained staff for a person to review. Confirmed with counsel 2026-09-21.

3. How We Collect Information

We collect information:

  • Directly from adult users, parents, guardians, learners, schools, and organizations
  • When an account is created or a Service is purchased or used
  • During classes, assessments, tutoring, events, support, or portal activity
  • From authorized schools, scholarship providers, voucher programs, payors, and partners
  • Automatically through devices, cookies, logs, and analytics
  • From service providers acting for us
  • From public sources when legally permitted and relevant

No person under 18 may independently create a Skhillz Academy account. A parent or legal guardian must create and manage a minor learner’s account, unless an eligible school or organization creates the account under a written license and applicable authorization.

4. Why We Use Information

We may use personal information to:

  • Create and administer accounts
  • Verify identity, age category, authority, and consent
  • Process enrollment, purchases, subscriptions, vouchers, scholarships, and payments
  • Deliver instruction, tutoring, assessments, memberships, events, products, and support
  • Personalize learning, recommend content, and monitor progress
  • Maintain attendance, academic, safety, and transaction records
  • Communicate with users and send necessary program notices
  • Operate Skhillz Storytime Studio and other live or recorded experiences
  • Provide accessibility accommodations and learner support
  • Protect learners, investigate incidents, and fulfill safeguarding duties
  • Moderate submissions and maintain safe community features
  • Maintain, secure, debug, analyze, and improve the Services
  • Prevent fraud, misuse, security threats, and violations
  • Comply with law, contracts, court orders, and regulatory obligations
  • Establish, exercise, or defend legal claims
  • Send marketing when permitted and honor communication preferences
  • Create aggregated or de-identified information that cannot reasonably identify an individual

We do not sell personal information. We do not use a child’s personal information for targeted or behavioral advertising. We do not require a child to provide more personal information than is reasonably necessary to participate in an activity.

Where the GDPR, UK GDPR, or similar law applies, our legal bases may include:

  • Performance of a contract requested by an adult user
  • Steps requested before entering a contract
  • Compliance with legal obligations
  • Legitimate interests in providing, securing, improving, and administering the Services, balanced against individual rights
  • Protection of vital interests, including safety
  • Consent, including verified parental authorization where required
  • Establishment, exercise, or defense of legal claims

Where we rely on consent, consent may be withdrawn prospectively. Withdrawal does not make prior lawful processing unlawful and may prevent us from providing a feature that requires the information.

6. Children’s Privacy

Parent-managed accounts

Parents and guardians control minor accounts, enrollment, billing, permissions, and optional submissions. Child profiles use privacy-protective defaults.

Children under 13 in the United States

When the US Children’s Online Privacy Protection Act applies, we provide direct notice to the parent or guardian and obtain verifiable parental consent before collecting personal information from a child, unless a legal exception applies. Parents may request access, correction, deletion, or cessation of further collection and may refuse optional disclosures.

School-authorized accounts

An eligible school or district may act as a parent’s agent for consent only when personal information is collected for the school-authorized educational purpose and not for an unrelated commercial purpose. We provide the institution with notice of our practices and use student information according to the agreement and applicable law.

Children outside the United States

Parental-consent thresholds vary. When consent is our legal basis, we seek parent or guardian authorization for minors below the applicable digital-consent age. Our default is to require parent or guardian account creation for every person under 18, regardless of location.

Child-facing design

We use age-appropriate explanations, high-privacy defaults, data minimization, restricted sharing, parent controls, and safety-focused design. We do not provide unmoderated private messaging between children or between an adult and a child.

7. Recordings, Images, and Learner Work

Recording is a condition of participation

Skhillz Academy delivers instruction virtually. All instructional sessions, tutoring sessions, Skhillz Storytime Studio events, and related live online activities are recorded. Recording is a standard operating condition of these Services and is not an optional setting. Notice is provided before participation, and enrolling in or attending a session constitutes participation in a recorded activity.

We record in order to deliver and document the Service: for instruction, accessibility, replay access for a learner who misses a session, attendance, quality assurance, staff supervision and training, and internal review. We also record so that if a concern, complaint, allegation, or safeguarding question is raised about conduct during a session involving minors, a contemporaneous record exists to review. This safeguarding purpose is a primary reason recording cannot be switched off for an individual participant.

A recording may capture a participant's name or display name, image, voice, video, chat messages, submitted work, and screen activity within the session.

Where a documented disability-related need or other legal obligation requires it, we will consider a reasonable modification to how a learner appears in a recording, such as participating with the camera off. A modification affects how a learner is captured; it does not exempt a session from being recorded.

Routine session recordings are generally retained for up to 12 months after the session, unless a longer period is reasonably required for an educational record, active account need, safeguarding matter, complaint, investigation, legal hold, or legal obligation.

Access to instructional recordings is limited to the Skhillz Academy personnel assigned to that learner or program, administrators with a legitimate need, the learner, and the learner's parent or guardian, together with authorized replay access within the program. Recordings are not used outside instruction, safety, quality, and internal review without the separate authorization described below.

Learner work

Learner work, including writing, drawings, projects, submitted media, and assessment responses, is saved to the learner's record as part of delivering and documenting instruction. Retaining this work is necessary to teach, to measure progress, and to maintain educational records; it is not an optional feature. It is retained for at least 12 months, and longer where an educational record, an active enrollment, a safeguarding matter, or a legal obligation requires it.

Skhillz Academy does not authorize participants to take screenshots, make recordings, or redistribute another person’s image, voice, work, or information.

Any use of a recording, image, voice, likeness, name, or identifiable work of a minor beyond instruction, safety, quality, and internal review requires separate parent or guardian authorization. This includes public or promotional use, marketing, case studies, teaching examples, and display to anyone outside the assigned personnel and the learner's own household.

That authorization is permission to be asked, not permission to publish. Where it is granted, the proposed material and the specific places it would appear will be provided to the parent or guardian for approval before publication whenever feasible, and the parent or guardian may refuse any individual item for any reason. Declining promotional permission, or refusing an individual item, does not prevent participation in core Services and has no effect on a learner's place in any program.

8. Artificial Intelligence and Automated Tools

We may use age-appropriate automated or artificial-intelligence-supported tools to personalize instruction, generate practice, support feedback, assist accessibility, analyze learning progress, moderate content, or improve operations.

We apply human oversight appropriate to the use and do not rely solely on an automated system to make a decision producing a legal or similarly significant effect on a learner. We limit information shared with providers, configure tools to protect information where available, and prohibit providers from using covered student information for unrelated advertising or commercial profiling.

Optional AI uses not necessary to provide the requested Service require a separate choice where required by law. Questions about a specific AI feature may be sent to privacy@skhillzacademy.org.

Written work a learner submits

In some learning tools a learner writes sentences, paragraphs, or other short pieces in response to an exercise. Where a tool offers automated feedback, that writing, together with the exercise it answers, is sent to an artificial-intelligence provider acting for us so that the learner can be told whether the writing did what the exercise asked and what is missing from it.

The provider is under contract and may use the writing only to return that feedback. It may not use it to train or improve any model, and it may not use it for advertising or commercial profiling. We send the exercise and the writing only. We do not attach the learner's name, contact details, or account identifiers, though a learner who writes their own name into a sentence will of course have written it.

Automated feedback is about a single exercise. It does not set a grade, decide placement, or affect enrollment, and a learner who cannot be given automated feedback, for any reason, can still complete the lesson.

Automated notice of a possible safety concern

The same reading may notice writing that suggests a learner is being harmed, is unsafe, or may be considering harming themselves. Where that happens, the matter is raised to trained staff through our safeguarding process, exactly as a concern raised by a person would be, and a person reviews it before anything else happens. No action is taken by an automated system alone, and the learner is not contacted by the tool.

This is a protective use, not a disciplinary one. We do not use automated reading to monitor learners for behavior, to police opinions, or to screen creative writing for content we dislike. A learner's imaginative or difficult subject matter is not, by itself, a concern.

9. When We Disclose Information

We may disclose information:

Service providers

To providers that perform payment, hosting, database, authentication, communications, video conferencing, analytics, security, support, assessment, accessibility, AI, shipping, accounting, or other functions for us. They may use information only as authorized by contract and law.

Schools, organizations, and authorized payors

To an institution that sponsors, licenses, funds, or administers the user’s participation, consistent with authorization, contract, and law.

Parents and guardians

To the verified parent or guardian managing a minor account, including information about participation, progress, safety, and account activity.

When reasonably necessary to protect a person, investigate suspected abuse or misconduct, report a safeguarding concern, comply with legal process, enforce agreements, or protect rights and security.

Business changes

In connection with a proposed or completed merger, financing, acquisition, reorganization, sale of assets, or similar transaction, subject to appropriate safeguards and applicable notice requirements.

At the user’s direction

When an adult user or authorized parent, guardian, school, or organization requests or consents to the disclosure.

We do not treat authorized service-provider processing as a sale of personal information. If our practices change in a way that creates a right to opt out under applicable law, we will provide the required mechanism before the change.

10. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including access controls, role separation, authentication, encryption where appropriate, monitoring, vendor review, staff training, and incident procedures.

No system is completely secure. Users must protect credentials, use unique passwords, sign out of shared devices, and notify us promptly of suspected unauthorized access.

11. Retention

We retain information only as long as reasonably necessary for the stated purposes, including educational, contractual, legal, accounting, safety, and dispute needs.

InformationGeneral retention approach
Routine session recordingsUp to 12 months, subject to stated exceptions
Account and profile dataWhile active and for a reasonable period after closure
Educational and attendance recordsAccording to program, institutional, and legal requirements
Consent and policy acceptance recordsFor the relationship and applicable limitation period
Transactions and tax recordsAs required for accounting, tax, fraud, and legal purposes
Safeguarding and incident recordsAccording to safety, legal, insurance, and limitation requirements
Marketing preferencesUntil withdrawn, plus suppression records needed to honor the choice
Cookies and technical logsAccording to the cookie settings and operational necessity

When information is no longer required, we delete, destroy, or de-identify it using reasonable measures. Backup copies may remain until securely overwritten under standard cycles.

12. International Data Transfers

Skhillz Academy operates from the United States. Personal information may be processed in the United States or other countries where providers operate. Those countries may have different data-protection laws.

When required, we use recognized safeguards for international transfers, such as contractual clauses, adequacy mechanisms, vendor commitments, supplementary protections, or consent permitted by law. International users may contact privacy@skhillzacademy.org for information about applicable safeguards.

13. Privacy Rights

Depending on location and subject to exceptions, an individual may have rights to:

  • Know whether and how information is processed
  • Access or obtain a copy
  • Correct inaccurate information
  • Delete information
  • Restrict processing
  • Object to processing, including direct marketing
  • Receive portable data
  • Withdraw consent
  • Appeal a denied request
  • Opt out of sale, sharing, targeted advertising, or qualifying profiling
  • Limit certain uses of sensitive information
  • Lodge a complaint with a regulator

We do not discriminate against a person for exercising a privacy right.

To submit a request, email privacy@skhillzacademy.org or contact us at the address above. We may verify identity and authority. A parent or guardian may exercise rights for a minor, and an authorized agent may submit a request where permitted. We will respond within the period required by applicable law.

California and other US states

Residents of jurisdictions with comprehensive privacy laws may receive the rights provided by their state. We do not knowingly sell personal information or share it for cross-context behavioral advertising. We do not knowingly use a minor’s data for targeted advertising.

EEA, United Kingdom, and Switzerland

Individuals may contact us regarding access, correction, erasure, restriction, objection, portability, consent withdrawal, or a complaint. They may also complain to their local supervisory authority. Mandatory local rights remain available notwithstanding any conflicting contract term.

Canada and other jurisdictions

Where applicable, users may request access, correction, consent withdrawal, and information about our privacy practices and service providers. We will honor additional mandatory rights required by local law.

14. Educational Records

Skhillz Academy maintains educational and participation records appropriate to its programs. When we provide services under contract to a school subject to the Family Educational Rights and Privacy Act or comparable law, our access and use are governed by the school agreement and applicable legal requirements. Direct-to-family programs are not automatically governed by FERPA merely because they are educational.

15. Cookies and Similar Technologies

We use essential technologies to provide security, login, preferences, and requested functions. With consent where required, we may use analytics, media, functionality, or advertising technologies as described in the Cookie Policy.

Nonessential technologies should remain disabled until required consent is obtained. Child-directed areas should not use targeted-advertising technologies.

16. Communications

We send transactional and service communications needed for accounts, billing, safety, schedules, and enrollment. Marketing communications are optional where required. Email recipients may unsubscribe through the message link. SMS recipients may follow the stated opt-out instruction. Opting out of marketing does not stop necessary service notices.

The Services may link to third-party websites, books, tools, stores, video platforms, or resources. Their privacy practices are their own. Parents and adult users should review third-party terms before use.

18. Changes to This Policy

We may update this Policy to reflect legal, operational, or technological changes. We will post the revised version with a new effective date. When required or when a change is material, we will provide additional notice and obtain renewed consent.

19. Contact and Complaints

Questions, concerns, complaints, and privacy requests may be sent to:

Read the Data Use ConsentHow the student's answers and results are used.

Revision note: Sections 5 and 8 changed from consent controls to notices; section 10 restated as permission to be asked. Confirmed with counsel 2026-09-04.

This document records the choices of an adult learner, parent, legal guardian, or authorized institutional representative concerning personal information used by Skhillz Academy, LLC.

It should be presented electronically with separate controls for required processing and optional uses. It must not be implemented as one blanket checkbox.

1. Adult Providing Authorization

  • Full name
  • Email address
  • Telephone number
  • Relationship to learner or institutional authority
  • Learner name and account identifier
  • Program or service
  • Date and method of consent

2. Authority Confirmation — Required for Minor Accounts

I certify that I am at least 18 years old and am the parent or legal guardian of the minor learner, or I am authorized by an eligible school or organization to create and administer the learner’s account. I understand that Skhillz Academy may request reasonable verification.

Control: Required unchecked checkbox

3. Core Service Data — Required

I authorize Skhillz Academy to collect and use information reasonably necessary to create the account, enroll the learner, provide instruction and support, personalize learning, document progress and attendance, process payment, communicate about the Service, protect safety, secure the platform, and comply with law, as described in the Privacy Policy.

This may include identity, contact, age, grade, school, educational progress, assessments, attendance, assignments, communications, technical activity, transaction information, accommodations, and safety information appropriate to the Service.

Control: Required unchecked checkbox

If the adult does not authorize necessary processing, Skhillz Academy may be unable to create the account or provide the requested Service.

4. Sensitive and Accommodation Information — Required Only When Supplied

I authorize Skhillz Academy to use health, disability, allergy, medication, emergency, accommodation, or other sensitive information that I provide for safety, accessibility, support, and administration. I understand that I should provide only information reasonably needed for those purposes.

Control: Contextual unchecked checkbox

5. Instructional Session Recording — Notice, Not a Choice

Skhillz Academy delivers instruction virtually. All classes, tutoring sessions, Storytime Studio events, and related live online activities are recorded. Recording is a standard operating condition of the Service. It is not presented as a permission, because it is not one, and offering a control that cannot be honored would be misleading.

This must be presented as a notice in the account area and before enrollment, in these terms:

Every Skhillz Academy class, tutoring session and Storytime Studio event is recorded. This is not optional and it is not a setting that can be switched off. Taking part in a Skhillz Academy program means being recorded.

A recording may capture the learner's name or display name, image, voice, video, chat, submitted work, and screen activity. We record for instruction, accessibility, replay for a learner who missed a session, attendance, quality, staff supervision, and internal review, and so that if a concern is ever raised about conduct in a session involving children there is a record to review rather than conflicting recollections.

Recordings are kept for up to 12 months and then deleted, unless a longer period is required for an educational record, an active account need, a safeguarding matter, a complaint, an investigation, a legal hold, or a legal obligation. They are visible to the Skhillz Academy personnel assigned to that learner, to administrators with a legitimate need, to the learner, and to the learner's parent or guardian, together with authorized replay within the program.

Other participants may be able to view an authorized replay within the program. Participants may not take screenshots, make independent recordings, or make copies.

Recordings are never used outside instruction, safety, quality and internal review without your separate permission, which is a choice you make below.

Control: Notice with acknowledgment at enrollment. No opt-out control is presented.

Because recording cannot be declined, the notice must appear before payment or enrollment, not only after, so that a family for whom this is unacceptable can decide not to enroll.

Where a documented disability-related need or other legal obligation requires it, consider a reasonable modification to how a learner appears in a recording, such as participating with the camera off. A modification changes how a learner is captured; it does not exempt a session from being recorded. Record the modification and the basis for it.

6. Artificial-Intelligence-Supported Learning — Core Use

I understand that Skhillz Academy may use human-supervised automated or artificial-intelligence-supported tools to personalize learning, generate practice, provide feedback, support accessibility, analyze progress, moderate submissions, or assist instructors. Skhillz Academy will limit data to the educational purpose and will not use child information for targeted advertising.

Control: Required acknowledgment when the selected Service necessarily uses these functions

7. Optional AI Product Improvement or Research

I permit Skhillz Academy to use the learner’s information for optional AI product testing, model evaluation, or research beyond what is necessary to deliver the enrolled Service. This choice is optional and may be withdrawn prospectively.

Control: Optional; default off

Do not use identifiable child content to train a general-purpose model under this permission without a separate, highly specific, counsel-reviewed notice.

8. Learner Work — Notice, Not a Choice

Learner work is saved to the learner's record as part of delivering and documenting instruction. Retaining it is necessary to teach, to measure progress over a year rather than a week, and to maintain educational records. It is not an optional feature.

This must be presented as a notice, in these terms:

Your child's writing, drawings, projects, submitted media and assessment responses are saved to their record. This is how a teacher sees progress across a year, and it is not optional.

Work is kept for at least 12 months, and longer where an educational record, an active enrollment, a safeguarding matter or the law requires it. It is visible to you, to your child, and to the Skhillz Academy staff assigned to them. Nobody else sees it unless you switch on one of the permissions below.

Control: Notice. No opt-out control is presented.

What remains optional is what is done with that work beyond instruction: submission to the moderated member showcase (section 9), and promotional, marketing or case-study use (section 10). Both are separate, default-off choices.

9. Moderated Member Showcase — Optional

I permit selected learner work to be submitted to a Skhillz Academy moderator for possible display in a restricted member showcase. I understand that submission does not guarantee publication and that Skhillz Academy may remove names or identifying details.

Select permitted attribution:

  • No name
  • First name only
  • Approved nickname or initials
  • First name and age/grade

Control: Optional; default off; parent approves each submission

10. Public and Promotional Media — Optional and Separate

Because all sessions are recorded as a condition of the Service, this permission is the control that governs any use of a recording beyond instruction, safety, quality and internal review. It is permission to be asked, not permission to publish.

I authorize Skhillz Academy to ask my permission to use specifically approved recordings, images, video, audio, quotations, first name, likeness, or learner work for the uses selected below. Enabling this setting does not authorize publication of anything. Skhillz Academy will show me the specific item and the specific places it would appear, and I may refuse any individual item for any reason. Declining this permission, or refusing an individual item, does not affect core program participation.

Select each permitted use separately:

  • Skhillz Academy website
  • Skhillz Academy social media
  • Email and digital advertising
  • Printed materials
  • Presentations and reports
  • Case studies and teaching examples
  • News or media releases

Select identification level:

  • No name
  • First name only
  • First name and general age/grade

Control: Optional; all default off; dated authorization and revocation mechanism required

Withdrawal applies to future use and content within Skhillz Academy’s control. It may not be possible to retrieve materials already lawfully printed, shared, archived, or redistributed by others.

11. Storytime Studio Questions and Participation — Optional

I permit the learner to submit questions, drawings, writing, or comments for use during a moderated Skhillz Storytime Studio session. Skhillz Academy may select, edit for length or privacy, or decline a submission.

Control: Optional; per-event or account-level parent choice

12. Marketing Communications — Optional

Email

I agree to receive optional news, offers, event announcements, and promotions by email. I may unsubscribe at any time.

SMS

I agree to receive optional marketing text messages at the number provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help.

Controls: Separate optional checkboxes; default off

Necessary account, billing, schedule, safety, and enrollment messages do not require marketing consent.

13. School or Organization Authorization

Where a school or organization creates student accounts:

I certify that the institution has authority to authorize the educational processing described in its agreement with Skhillz Academy and has provided required notice or obtained required permission. Student information will be used for the institution-authorized educational purpose and not for unrelated commercial purposes.

Control: Required institutional attestation completed by an authorized administrator, not an individual teacher unless the institution expressly authorizes the teacher

14. Rights and Revocation

The adult account holder may review or change optional permissions in account settings or by contacting privacy@skhillzacademy.org. Some records may be retained when required for education, accounting, safety, consent evidence, disputes, or law.

Revoking optional permission does not affect earlier lawful processing. Revoking processing necessary to provide a Service may require discontinuing that feature or account.

15. Electronic Record

The system must retain:

  • Exact consent text and version
  • Each individual selection
  • Date and time
  • Adult account identifier
  • Learner identifier
  • Program
  • Verification method
  • Source page or workflow
  • Withdrawal or modification history

These Terms of Service (“Terms”) are a binding agreement between Skhillz Academy, LLC (“Skhillz Academy,” “we,” “us,” or “our”) and the adult person or organization accessing, purchasing, or authorizing use of our websites, portals, programs, memberships, products, and services (“Services”).

By creating an account, enrolling, purchasing, or using the Services, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Services.

2. Incorporated Policies

The following form part of these Terms when applicable:

  • Privacy Policy
  • Tuition, Refund and Withdrawal Policy
  • Attendance and Make-Up Policy
  • Code of Conduct
  • Child Safety and Safeguarding Policy
  • Data-Use Consent
  • Cookie Policy
  • Program-specific enrollment agreement, order, syllabus, or license

If an individually signed program agreement conflicts with these general Terms, the more specific agreement controls for that subject. Mandatory legal rights always control where they cannot be waived.

3. Eligibility and Authority

You must be at least 18 and legally capable of entering a contract to create an account, purchase a Service, or accept these Terms.

No person under 18 may independently register. A parent or legal guardian must create and manage a minor learner’s account and authorize participation, unless an eligible school or organization creates the account under a written agreement and applicable authority.

By creating a minor’s account, you represent that you are the minor’s parent or legal guardian or otherwise possess lawful authority. By acting for an organization, you represent that you may bind it.

4. Accounts

Provide accurate, current, and complete information. Keep credentials confidential and promptly update changed information. You are responsible for activity under your account except to the extent caused by our failure to use reasonable safeguards.

Adult account holders are responsible for supervising minor use, reviewing permissions, and ensuring compliance. Skhillz Academy may require verification of identity, age, parental relationship, institutional authority, payment authority, or consent.

We may restrict or suspend an account to protect users, investigate misuse, comply with law, address nonpayment, or enforce these Terms.

5. Services and Program Changes

Descriptions, schedules, instructors, features, content, and availability may change. We may make reasonable substitutions, reschedule sessions, update curriculum, change technical providers, or discontinue a feature. If we materially discontinue a prepaid Service without a reasonable substitute, we will provide the remedy required by the applicable policy or law.

Unless expressly stated in an enrollment agreement, a program does not guarantee accreditation, grade promotion, admission, employment, test score, credential acceptance, or a particular academic outcome.

6. Orders and Payment

Prices and material terms are displayed at checkout or in an enrollment agreement. You authorize Skhillz Academy and Stripe or another disclosed provider to charge the selected payment method for amounts due, including recurring charges, installments, shipping, and taxes when applicable.

You represent that you are authorized to use the payment method. A third party may pay with authorization, but payment does not grant access to private learner records unless separately authorized.

Physical products may be subject to shipping charges and applicable tax. Taxes on products or services will be collected when legally required.

7. Subscriptions, Renewals, and Price Changes

Subscription and payment-plan terms must be disclosed before purchase. Unless canceled, a recurring subscription renews at the stated interval and the payment method is charged automatically.

You may cancel an online subscription through the account billing area or another clearly disclosed method. Cancellation stops future renewal charges but does not ordinarily refund an amount already paid or restore an expired promotion.

We will provide at least 30 days’ advance notice of a material recurring-price increase, unless a longer period is required. If you do not accept the increase, cancel before it takes effect.

8. Failed Payments and Fees

We may attempt a failed recurring payment up to three times. During that period, access may be limited. If payment remains unsuccessful, we may suspend or cancel the account and recover lawful amounts already due.

When disclosed before purchase, Skhillz Academy may assess a failed-payment or returned-payment charge equal to the lesser of $35, our reasonable permitted cost, or the maximum allowed by applicable law. We will not impose a prohibited penalty. Financial institutions or payment providers may charge separate fees that we do not control.

9. Scholarships, Vouchers, Discounts, and Third-Party Funding

Scholarships, vouchers, grants, promotional codes, and discounts are subject to eligibility, funding availability, stated conditions, and verification. They have no cash value unless required by law and may not be transferred or combined unless allowed.

If a sponsor, voucher issuer, school, or other payor fails to pay, responsibility for any balance depends on the enrollment agreement and applicable law. We will disclose known learner responsibility before enrollment when practicable.

10. Refunds, Withdrawal, and Attendance

The Tuition, Refund and Withdrawal Policy governs refunds and withdrawal. The Attendance and Make-Up Policy governs lateness, cancellations, missed sessions, and make-ups.

Digital content and memberships are generally nonrefundable after access or delivery, subject to mandatory law. Annual tutoring purchases and amounts paid under tutoring or other program plans are nonrefundable as described in the applicable policy and enrollment terms.

11. Physical Products

Unless stated otherwise, books, Discovery Boxes, kits, consumable materials, downloads, and personalized products are final sale. This does not eliminate nonwaivable rights concerning damaged, defective, incorrect, counterfeit, or undelivered products.

Report shipping damage, missing items, or an incorrect order to support@skhillzacademy.org within 14 days after delivery or the expected delivery date. Provide the order number and reasonable evidence. Available remedies may include replacement, reshipment, store credit, carrier claim, or refund where required.

Risk of loss and title pass as provided by applicable law and the shipping terms displayed at purchase.

12. Learning, Safety, and Adult Supervision

Activities may involve household materials, tools, movement, outdoor observation, food, internet use, or other risks. Follow instructions, safety warnings, age recommendations, and adult-supervision indicators. A parent or responsible adult must determine whether an activity is suitable for the learner and provide supervision.

Do not substitute hazardous materials or exceed the intended activity. Notify us of relevant accommodations or safety concerns. In an emergency, contact local emergency services.

13. Live Sessions and Recordings

Live instruction may be provided through Zoom or another embedded or linked platform. All sessions are recorded. Recording is a condition of participation in these Services, not an optional setting, and notice is given before participation. Recordings are used for instruction, accessibility, replay, attendance, safety, quality, staff supervision, and internal review, and so that a concern raised about conduct in a session involving children can be reviewed. The Privacy Policy describes what is captured, who may see it, and how long it is kept.

Use of a recording beyond those purposes, including promotional, marketing or case-study use, requires the separate permission described in the Data-Use Consent, and that permission is permission to be asked rather than permission to publish.

Participants may not record, photograph, screenshot, stream, copy, or distribute a session or another participant’s information without express written permission.

An adult must not privately message a minor outside authorized, observable systems and established safeguarding procedures. Parents and guardians may be required to assist with technology or supervision.

14. Acceptable Use

You may not:

  • Violate law, another person’s rights, or the Code of Conduct
  • Harass, threaten, exploit, groom, impersonate, or endanger anyone
  • Seek private contact with a minor outside authorized channels
  • Upload malware or interfere with security or operation
  • Share credentials or permit unauthorized account use
  • Scrape, crawl, reverse engineer, bypass access controls, or automate extraction
  • Upload unlawful, infringing, deceptive, sexually explicit, hateful, or dangerous content
  • Publish personal information about another person without authorization
  • Use the Services to train a competing system or create derivative commercial products
  • Resell, redistribute, or publicly display member materials without a license

15. Intellectual Property

The Services, curriculum, characters, designs, text, graphics, audio, video, software, assessments, downloads, trademarks, and other Skhillz Academy content are owned by or licensed to Skhillz Academy and protected by law.

Subject to payment and compliance, we grant the account holder a limited, personal, nonexclusive, nontransferable, revocable license to use purchased or membership content for the stated household or individual educational purpose. School, organization, classroom, group, commercial, and public use require the appropriate license.

No ownership is transferred. Remove no notices. You may not copy, sell, sublicense, publish, upload, distribute, adapt, or exploit content except as expressly authorized.

16. Learner Work and User Content

The creator retains ownership of original learner work. By submitting content, the adult account holder grants Skhillz Academy a limited, nonexclusive license to host, store, process, reproduce, and display it as reasonably necessary to provide, secure, moderate, and administer the Service.

Public or promotional use requires the separate permission described in the Data-Use Consent. You represent that submitted content is lawful and that you possess the necessary authority and permissions.

We may remove content that violates policy, creates risk, infringes rights, or is unsuitable for the Service.

17. Feedback

If you voluntarily provide suggestions about the Services, we may use them without restriction or compensation, provided we do not publicly identify you or a minor without permission.

18. Third-Party Services

The Services may depend on Stripe, Zoom, hosting, communication, video, shipping, or other providers. Their services may be governed by separate terms. We are not responsible for independent third-party products or conduct, but we remain responsible for our own legal obligations and vendor oversight.

19. Suspension and Termination

We may suspend or terminate access for nonpayment, fraud, safety risk, material policy violation, abuse, unlawful conduct, or interference with the Services. When circumstances permit, we may provide notice and an opportunity to correct the issue. Immediate action may be taken to protect a child or another person.

Termination for conduct or safety does not automatically create a refund. Mandatory rights and the applicable refund policy still apply.

You may close an account or withdraw according to the applicable procedures. Provisions concerning payment obligations, intellectual property, confidentiality, disclaimers, liability, disputes, and records survive where appropriate.

20. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties to the extent they may lawfully be disclaimed, including merchantability, fitness for a particular purpose, title, and noninfringement.

We do not warrant uninterrupted access, error-free technology, compatibility with every device, or a particular educational result. These disclaimers do not exclude warranties or remedies that cannot legally be excluded.

21. Limitation of Liability

To the fullest extent permitted by law, Skhillz Academy and its owners, officers, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, goodwill, or opportunities arising from the Services.

To the fullest extent permitted by law, aggregate liability arising from a claim will not exceed the amount the claimant paid to Skhillz Academy for the Service giving rise to the claim during the 12 months before the event.

These limitations do not apply to liability that cannot lawfully be limited, including where applicable fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, violation of statutory consumer rights, or certain privacy obligations.

22. Indemnification

To the extent permitted by law, an adult user or organization agrees to defend, indemnify, and hold Skhillz Academy harmless from third-party claims arising from that party’s unlawful conduct, unauthorized content, material breach, misuse of the Services, or false representation of authority. This provision does not require indemnification for Skhillz Academy’s own unlawful conduct.

23. Governing Law and Disputes

Before filing a claim, the parties should send a written description to legal@skhillzacademy.org and attempt in good faith to resolve it for at least 30 days, unless urgent relief or law requires otherwise.

These Terms are governed by Florida law, without regard to conflict-of-laws principles. Subject to mandatory law, exclusive venue lies in the state or federal courts serving Orange County, Florida. Eligible small-claims matters may be filed in a court with lawful jurisdiction.

Nothing in these Terms deprives a consumer of mandatory protections or a lawful forum that cannot be waived in the consumer’s jurisdiction.

24. Changes

We may modify these Terms. We will post the revised version and effective date. Material changes will receive additional notice where required. Continued use after the effective date constitutes acceptance only to the extent permitted; renewed affirmative acceptance will be obtained when legally required.

25. General Terms

If a provision is unenforceable, it will be limited or severed to the minimum extent necessary. Failure to enforce a provision is not a waiver. You may not assign the agreement without our consent; we may assign it as part of a lawful business transaction. Electronic notices and signatures may be used. Headings do not alter meaning.
